Terms of service

By creating an account or using Orkasa, you accept these terms. If you do not agree, do not use the service. If you act on behalf of a company, you represent that you have the authority to bind it.

Orkasa is a B2B SaaS platform providing a real estate CRM, AI-powered listing studio, multi-portal publishing, lead management and compliance. The service is offered “as is”, with continuous improvements at Orkasa's discretion.

You are responsible for keeping your password secure and for all activity under your account. Notify us immediately of any unauthorized access.

• Plans are billed monthly or annually, in USD, in advance.
• Free 14-day trial period. If you do not cancel before the trial ends, automatic billing begins.
• You can cancel anytime. Cancellation takes effect at the end of the current billing period. We do not refund partial months.
• If a payment fails, you have 7 days to settle it before the account is suspended.

You may not use Orkasa to:

• Publish illegal, fraudulent or deceptive content.
• Send spam or unsolicited messages to leads who have not given their consent.
• Perform scraping, reverse engineering or access the infrastructure without authorization.
• Upload personal data without the corresponding legal basis (consent, contract, etc.).
• Upload content that infringes third-party intellectual property (unlicensed photos, logos without permission).

A material violation results in immediate suspension, without refund.

Orkasa retains all rights over the software, the brand, and the derived AI models. You retain the rights to your listings, photos, leads and data, and grant us a limited, revocable license to process them in the context of the service.

AI-generated content (text, edited images) is provided as a suggestion. You are responsible for reviewing and validating it before publication. Orkasa does not guarantee factual accuracy and is not liable for generated content you have not validated.

Inputs (prompts, photos) and outputs are not used to train Anthropic or Google models.

We make a best effort for 99.9% availability on Solo and Team plans. The Brokerage plan has a contractual SLA with credits for non-compliance. Scheduled maintenance is announced 72h in advance.

To the maximum extent permitted by law, Orkasa's aggregate liability for damages shall not exceed the amount paid by you in the 12 months preceding the event giving rise to the claim.

Orkasa is not liable for: loss of business opportunities, decisions made based on AI-generated content, failures of third-party portals or social networks, or indirect / consequential damages.

You may terminate the account at any time from the dashboard. Orkasa may terminate the account for: material breach of these terms, non-payment for more than 30 days, or legal requirement. We give you 30 days to export your data.

We notify material changes by email at least 30 days in advance. Continued use of the service after the effective date constitutes acceptance.

These terms are governed by the laws of the Republic of Panama. Any dispute shall be resolved in the courts of Panama City.
